Membership Agreement
The following rules have been established to make borrowing toys from Rutabaga Toy Library an enjoyable experience for all of our members. Please review carefully and contact us with any questions or concerns.
“Members” are defined as person(s) who are registered to participate in the Rutabaga Toy Library membership program and are in good standing with Rutabaga Toy Library. “Members” can be either the caregiver or parent who has agreed to join the program on behalf of themselves and/or their child/children.
Parents and/or legal guardians who wish to join on behalf of their child/children must purchase a membership at Rutabaga Toy Library. The Member will identify on the membership agreement the child/children covered under the agreement. Each member may also designate up to three adults (“Designated Adults”) to act as agents in their stead in connection with fulfilling their non-financial membership responsibilities under this membership agreement. The alternative parent or caregiver may be included as one of the Designated Adults under a membership agreement.
Each Adult who wants to include their child/children in membership privileges must identify (see each covered child/children and pay a membership fee according to the fee schedule below. The membership will be issued to the Adult member who is legally responsible for the child/children and legally responsible for who will be responsible for compliance with the membership terms. The membership fee schedule is as follows;
Month-to-month: $45.00 (4 toys at a time)
10% discount if billed bi-annually, 15% discount if billed annually
Additional toy fee (2 additional toys per month): $10.00
Only members of Rutabaga Toy Library (and/or their Designated Adults) may borrow toys from Rutabaga Toy Library.
A limit of four (4) toys per child covered under a membership agreement may be borrowed at any one time, on a first-come first-served basis. There are no reservation options at this time. No member may have more than four (4) toys per covered child checked out at any one time.
You may return and exchange toys as often as you like, keeping them up to 4 weeks (28 days).
Borrowed toys may be renewed for one additional term of 4 weeks (28 days). If any toy is not returned by it’s due date, the responsible member will be assessed a fine.
The fine for overdue toys is $1 per toy, per day, beginning with day 28 or the next day Rutabaga is open.
Additional toys may not be checked out by members with overdue toys or outstanding fines or fees.
Unless enrolled in auto-pay, membership expires at the end of the prepaid membership term. Your account will remain on auto-renew if you have toys checked out. Members will receive notification of upcoming expiration. Membership sales are final.
Extended memberships will continue consecutively, even if paid after the previous expiration.
Some playspace toys and books may not be borrowed and are only accessible on-site.
Members are encouraged to test out toys to select the perfect toy to borrow. In this process, we ask that a toy be returned to the shelf before exploring another toy.
Members are encouraged to inspect toys and count pieces and the toy components prior to borrowing.
Members are responsible for the safety of each covered child while on site and/or when engaged with borrowed toys. Toys should be played with as intended and the member and/or designated adults are expected to supervise play as you would with any toy and child. Rutabaga Toy Library assumes no liability for the child/children engagement with toys used either in the home or at Rutabaga Toy Library. That responsibility rests with the Member and/or their designated adult(s). Rutabaga Toy Library makes no warranties, guarantees, or promises as to the safety of any toy. The member is responsible for conducting its own research regarding any toy which they are interested in borrowing or allowing the covered child/children to handle. Designated adults or parents assume responsibility for ensuring their covered child uses each toy safely, and further assumes the responsibility for inspecting each toy prior to allowing the child/children to play with it and/or prior to borrowing it for offsite use. The Member is responsible for inspecting the toy to ensure that there are no damages or defects to the toy before allowing the child/children to engage with the toy and/or before borrowing the toy for offsite use. Each member is required to promptly report to Rutabaga Toy Library any observed defects or damages to any toy whether caused by the member, a covered child or otherwise and to promptly surrender that toy to Rutabaga Toy Library personnel.
All toys are the responsibility of the member while on loan. Members are asked to treat the toys and packaging with care, thoroughly clean and inspect toys prior to return, and return the toys in their bags/boxes in a clean and dry condition.
If items are returned in an unsatisfactory condition, damage fees will be applied. The damage fee will be an estimated replacement value of the item.
Damage or lost toys:
If a piece has been misplaced, you may return the toy and continue to look around for the missing piece.
If a toy part is damaged or lost but Rutabaga Toy Library determines that the use will not be adversely affected, a small charge of $1 will be assigned.
If the misplaced piece cannot be timely located or if the broken toy not able to be repaired, the member will be asked to replace the toy with a preferably pre-owned toy in the same category and price range. If this is not possible, the member will be assigned a loss fee equal to the cost of replacing the toy.
Rutabaga Toy Library reserves the right to suspend or cancel the membership or toy borrowing privileges of anyone who repeatedly violates these rules. Any monies paid prior to the suspension or cancellation are non-refundable. In the event a member behaves in such a way that would invoke the provisions under this provision, Rutabaga Toy Library will provide the member with one warning prior to suspension or cancellation.
